The website is owned and operated by True Merchant Services, LLC, referred to in these Terms as "True Merchant Services," "TMS," "we," "us," or "our."
By accessing or using this website, submitting information, or uploading a processing statement, you agree to these Terms. If you do not agree, please do not use the website.
1. Website purpose
True Merchant Services provides information and consulting related to merchant accounts, credit and debit card processing, point-of-sale systems, payment gateways, interchange pricing, cash-discount and surcharge programs, PCI compliance, and related payment services.
Website content is provided for general informational and educational purposes. It is not legal, tax, accounting, cybersecurity, or financial advice.
2. No merchant-processing agreement created
Using this website, contacting us, requesting information, or receiving a free processing-statement review does not create a merchant-processing agreement, advisory relationship, partnership, or other binding business relationship.
Any merchant-processing services, equipment, software, pricing, funding arrangements, or related services will be governed by separate applications, agreements, underwriting requirements, card-network rules, processor terms, and financial-institution requirements.
If these Terms conflict with a separately signed merchant or service agreement, the signed agreement will control with respect to the services covered by that agreement.
3. Eligibility and business use
This website is primarily intended for business owners and authorized business representatives who are at least 18 years old.
By submitting information on behalf of a business or organization, you represent that you have authority to provide the information and communicate with us on that organization's behalf.
4. Free statement reviews
True Merchant Services may offer a complimentary review of a business's payment-processing statement.
A statement review:
- Is provided for informational and comparison purposes.
- Does not obligate you to purchase or change services.
- Is based on the accuracy and completeness of the information provided.
- May involve estimates when complete pricing or transaction information is unavailable.
- Does not guarantee approval, specific pricing, savings, funding times, or future results.
Actual pricing and savings may vary depending on card mix, transaction size, processing method, industry, merchant category, equipment, chargebacks, interchange qualification, card-network changes, and other factors.
5. Uploaded statements and submitted information
By uploading a processing statement or submitting business information, you represent that:
- You are authorized to provide the document or information.
- The material does not violate another person's rights or any legal obligation.
- You have removed any information that is unnecessary for the requested review.
- The information is accurate to the best of your knowledge.
Do not upload full payment-card numbers, bank-account passwords, Social Security numbers, authentication credentials, or other information that is unnecessary for a processing review.
We may use submitted information to respond to your request, evaluate processing costs, prepare comparisons, recommend services, communicate with processors or service providers when authorized, and perform other activities described in our Privacy Policy.
Although we use reasonable safeguards, no internet transmission or storage system can be guaranteed completely secure. Information you submit is also subject to our Privacy Policy.
6. Pricing, savings and funding claims
Examples, comparisons, rates, savings calculations, and funding timelines shown on this website are illustrations and are not guarantees.
Merchant-services pricing and eligibility depend on underwriting, processing history, transaction volume, industry, card types, risk profile, equipment, processor requirements, card-network rules, and other factors.
"Next-day funding" and similar statements are subject to approval, cutoff times, banking schedules, holidays, transaction review, processor policies, and the merchant's financial institution.
Final pricing and service terms will be stated in the applicable written agreement.
7. Compliance information
Information concerning PCI DSS, surcharging, cash discounts, dual pricing, convenience fees, card-network rules, or state and federal requirements is general information only.
These requirements can change and may vary by location, card brand, transaction type, and business model. You are responsible for confirming that your practices comply with applicable laws, processor requirements, and card-network rules.
Consult qualified legal, tax, accounting, or compliance professionals when appropriate.
8. Third-party providers and services
True Merchant Services is an independent merchant-services advisor and may introduce or connect businesses with processors, acquiring banks, equipment providers, software companies, gateways, financing providers, or other third parties.
Those services are controlled by their respective providers and may be subject to separate terms, privacy policies, underwriting, pricing, and approval requirements.
We do not control and are not responsible for a third party's systems, outages, security, approvals, funding decisions, service performance, policy changes, or website content.
Links to third-party websites are provided for convenience and do not necessarily constitute an endorsement.
9. Acceptable use
You may not:
- Use this website for unlawful, fraudulent, or abusive purposes.
- Submit false, misleading, stolen, or unauthorized information.

To the fullest extent permitted by law, our total liability arising from use of this website will not exceed the amount you paid directly to True Merchant Services for the website-related service giving rise to the claim during the six months before the claim. If you paid nothing, our total liability will not exceed $100.
Some jurisdictions do not allow certain liability exclusions, so portions of this section may not apply to you.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless True Merchant Services and its owners, employees, representatives, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

15. Governing law
